TRANSPARENCY PROGRAM

  • Based on Article 7 of Law no. 119/2014 “On the Right to Information” (hereinafter “LDI”), the Public Authority (hereinafter “PA”) must publish the Transparency Program (hereinafter “PT”) approved by the Commissioner for the Right to Information and Personal Data Protection (hereinafter “Commissioner”). “Për të drejtën e informimit” (në vijim “LDI”), Autoriteti Publik (në vijim “AP”) duhet të publikojë Programin e Transparencës (në vijim “PT”) të miratuar nga Komisioneri për të Drejtën e Informimit dhe Mbrojtjen e të Dhënave Personale (në vijim “Komisioneri”).

    PA must publish information according to its functional activity and review and update the PT in any case of change in institutional activity, the legal regulatory framework or any other element related to proactive transparency.

    PT specifies the categories of information that must be made public. Public information without a request must be: complete, accurate, up-to-date, easy to consult, understandable, easily accessible and compatible with the original documents in the possession of the PA. Also, before publishing the information, the PA must assess whether there are any legal restrictions on publication.

    Acts containing rules, norms or restrictions on the fundamental rights and freedoms of the individual, as well as those with direct effect on them, are made public by displaying or posting on the official website, within 48 hours of the act's approval by the PA.

    Transparency program specifies the categories of information that must be made public, the manner of publication, and the legal provisions from which the obligation to publish arises. When publishing information, PA must take into account the public interest and facilitate easy access to public information.

    Functions and tasks of the Responsible Authority are as follows, as defined in the Regulation approved by Order of the Minister of Tourism and Environment no. 178 dated 20.05.2022, "On the Approval of the Internal Regulation on the Organization and Functioning of the National Forest Agency", Article 3, as follows:

    Functions of the National Forest Agency

    • National Forest Agency is a central public entity under the ministry responsible for forests, which exercises its jurisdiction throughout the area of the Republic of Albania;
    • National Forest Agency is funded from the State Budget and other legal sources;
    • National Forest Agency mission is: "Well management of the forest at the national level, their conservation and development, the sustainable and multifunctional use of resources in the national forest area, as a natural asset of national importance".
    • National Forest Agency has self-sufficiency in decision-making and the performance of its functions, as provided for by Law;
    • Council of Ministers shall adopt detailed rules for the organization and functioning of the National Forest Agency and the Regional Forest Agencies, the division and organization of the job, the status of employees and its relations with other entities;
    • National Forest Agency is headquartered in Tirana and has its own stamp.

      Technical steps to fill the form for information

      Every citizen own the right to access public information, without being obliged to explain the reasons.

      Every citizen has the right to be acquainted with public information, through the original document, or by receiving a copy of it in a form or format that allows full access to the content of the document.

      Claim for Information It is done in writing and sent by hand, by mail or by e-mail, correctly presenting the identity of the applicant and his signature.

      Claim for Information must contain: 1. the name and surname of the applicant; 2. the postal or electronic address where the information is requested to be sent; 3. a description of the information requested; 4. the format in which the information is preferred; 5. any data that the applicant considers may assist in identifying the requested information. The request for information is processed by the agency as soon as possible, but no later than 10 working days from the date of its submission.

      When the claim is unclear regarding its content and nature, the agency immediately contacts the person to provide the necessary clarifications, but always no later than 48 hours from the date of submission of the request.

      If after reviewing the application Agency find that it does not possess the requested information, no later than 10 calendar days from the date of submission of the request, it shall send it to the competent authority, also informing the requester.

      Public administration facilities are free of charge. The provision of information may be made for a fee, previously defined and done public by the agency on its website and in public reception areas.

      Acess to information is limited only according to the cases provided for in article 17 of law no. 119/2014 "On Access to Information"

  • Notification of recruitment procedures is carried out by the Department of Public Administration according to the annual recruitment plan and admission to the civil service is carried out by the PA in cooperation with the Department of Public Administration. Recruitment/admission procedures in the civil service referred to in Article 7 of Law 152 “On the Civil Servant” as amended, the Department of Public Administration prepares and supervises the implementation of state policies in the civil service; prepares draft legal and sub-legal acts for the civil service; supervises the implementation of civil service legislation in state administration institutions; prepares an opinion on any draft act proposed by other institutions related to employment relations in the public administration; approves and monitors the implementation of training programs in the civil service; prepares the annual admission plan for state administration institutions; represents, together with the Ministry of Finance, the Council of Ministers in negotiations and consultations on general working conditions in the civil service with trade unions or representatives of civil servants; administers the Central Personnel Registry; supports and provides advice to institutions in the implementation of this law; prepares general instructions and manuals to guarantee the unified implementation of civil service legislation in state administration institutions; in accordance with the legislation in force, drafts and cooperates on the salary structure for civil servants and employees of public administration, central and local; drafts and approves recommendations for civil servant training policies; exercises any competence granted by this law or on its basis. Based on Article 22 of Law 152 “On Civil Servants”, as amended, admission to the civil service in the executive category is carried out through an open competition. The competition is periodically organized by the unit responsible for each of the groups defined in point 8 of Article 19 of this law. The competition is carried out in these two phases: a) preliminary verification, if the candidates meet the general and special requirements, according to the competition announcement; b) evaluation of the candidates. The preliminary verification is carried out by the responsible unit, while the evaluation of the candidates is carried out by the permanent admission committee, established for each of the groups specified in point 8 of Article 19 of this law. The winning candidates, who receive over 70 percent of the total evaluation points, are ranked by the permanent admission committee, according to the points received in the list of successful candidates (hereinafter referred to as the “list”). The Council of Ministers shall adopt the detailed rules for the establishment, composition and operation of the permanent admission committees, as well as the detailed rules for the admission procedure and the evaluation of candidates.
